  1. Disqualification of 20 MLAs of AAP by the Election Commission of India. They were deemed to have been holding office of profit as they were Parliamentary Secretaries to the ministers in the Delhi govt.

The Concept Office of Profit underlines the Doctrine of Separation of Power. Indian Constitution adopted this idea under Article 102(1) (a) and 191(1) (a). Nowhere in the constitution has the concept of office of profit been defined.

Analysis: The post of Parliamentary Secretary is created to reward those who do not find berth in the cabinet due restrictions imposed by the 91st Constitutional Amendment Act, 2003. Article 164(1A) restricts no. of ministers to 15% of the total MLA/MPs and 10% for Delhi.

Article 164(1A) was inserted on the recommendations of the National Commission to review the working of the Constitution (NCRWC) also known as Justice Venkatachaliah Commission. It was formed in 2000 by the NDA government and gave its report in 2002.
