Anti Defection Law

The Tenth Schedule Popularly Known as the Anti Defection Law Was Included in Constitution by Rajiv Gandhi Ministry in 1985 And Sets the Provision For Disqualification of Members on the Ground of Defection to Another Political Party.                                                                                       The Law Was Added as 52nd Amendment Act,1985 Seen After the Rajiv Gandhi Government Came to Power After Assassination of Indra Gandhi.


Grounds For Disqualification

(1) If an Elected Member Voluntarily Gives up his Membership of a Political Party.

(2) If he Votes or Abstains form Voting, Contrary to any Divection Issued by his Political Party or Anyone Authoritised to do so Without Obtainin Prior Permission.
